Medical Malpractice is a serious problem in the United States. While the vast majority of physicians provide excellent care to their patients, statistics on medical malpractice are alarming. A recent study by the Institute of Medicine of the National Academy of Sciences estimated that as many as 98,000 patients may be killed each year by hospitals alone as a result of medical malpractice. In 1984, Harvard researchers found that 1 % of a representative sample of patients treated in New York State Hospitals were injured and 1/4 of those died, because of medical malpractice. Nationwide, this would have translated into 243,000 injuries and 80,000 deaths in 1988 from negligence in American hospitals. Most of this involves physicians. There has been no clear evidence that there has been a significant improvement since that time.

What is the Law in Connecticut in the Area of Medical Malpractice?

Connecticut law provides that in order to pursue a medical malpractice suit, the injured person must prove the requisite standard of care for treatment, that the medical provider deviated from that standard of care and that the medical provider’s negligence caused the patient to sustain injuries. Generally, expert testimony is required to establish both the applicable standard of care as well as the breach of that standard by the medical provider.
