Motor Vehicle Accident

Motor Vehicle Accident - On February 28, 2019, a 42 year old, married woman from Guatemala, was crossing Fairfield Avenue in Stamford, Connecticut in a crosswalk, when the defendant made a left hand turn from Richmond Hill Avenue onto Fairfield Avenue and struck Ms. Tobar, causing her to strike the defendant's windshield and further causing her to sustain various injuries, including a closed lateral tibial plateau fracture of the left leg. The case proceeded to trial and on December 1, 2022, Judge James Genuario rendered judgment for the plaintiff in the amount of $179,888.44. Motor Vehicle Accident - On January 6, 2013, a 91 year old female was a passenger in a motor vehicle that was proceeding into the intersection of East Street and Salmon Brook Road in Granby, Connecticut, where there was a red blinking light and a stop sign, when her motor vehicle was broad sided by a vehicle that was proceeding into the intersection from Salmon Brook Street on a yellow blinking light, causing her to sustain severe injuries. After suit was instituted, the case settled for both drivers' policy limits totaling $1,350.000.00.

Motorcycle Accident - $535,000.00 settlement for a man injured when struck while riding a motorcycle in Greenwich. As a result of his injuries, the man was caused to undergo surgery on his left hand and wrist for repair of the tendons in his finger and repair of the ulnar nerve and reinforcement of the ulnar nerve in his wrist. Motor Vehicle Accident - Two 25 year old female passengers were in a motor vehicle that was rear-ended while stopped in traffic on the Merritt Parkway in New Canaan, Connecticut. Truck Accident

Truck Accident - $339,000.00 settlement for a 25 year old truck driver from New Jersey who injured his back after he was rear ended by a flatbed truck while driving on I-95 in New Haven, Connecticut. The truck driver later sought treatment with various medical providers in New Jersey and he was diagnosed with a herniated disc at L4-5, although he did not undergo surgery. Truck Accident - $275,000.00 settlement for a 53 year old bus driver who was injured when he was rear ended by a tractor trailer truck while stopped at a red light on Washington Boulevard in Stamford, Connecticut. The bus driver sustained extensive injuries to his neck and back, including a grade II spondylolisthesis secondary to bilateral spondylolysis as well as aggravation of a pre-existing low back condition. The case settled for $275,000.00 after evidence had started but before the trial had been completed.

Truck Accident - $100,000.00 settlement for 3 passengers in a motor vehicle who were injured as a result of being rear ended by a tractor trailer truck in Clinton, Connecticut. Slip and Fall

Slip and Fall - On February 21, 2006, a 27 year old man was descending the stairs leading to the basement of the restaurant where he worked when the stairs suddenly collapsed, causing him to lose his balance and strike the stairs with his back, and further causing him to sustain a spinal cord injury. The claims of negligence against the defendant landlord were that the stairs lacked any handrails, which is negligence per se and a violation of the Connecticut Fire Safety Code, as well as the fact that the stringer on the right side of the stairs was not properly attached to the floor beam and simply gave way when the plaintiff began to descend the stairs. Slip and Fall Accident - In 2010, a thirty-five year old Southington man sustained a severe sprain to her his ankle when he was caused to slip and fall on snow that was located on steps of an apartment building in Meriden, Connecticut. Slip and Fall - In January 2010, a forty-five year old woman, was caused to slip and fall on black ice located in a parking lot of a commercial shopping plaza in Wallingford, Connecticut. As a result of the accident, the plaintiff sustained various injuries including a herniated disc at L3-4, herniated disc at C5-6, left hand numbness and an injury to her left shoulder resulting in adhesive capsulitis in the shoulder. Lead Poisoning

Lead Poisoning - A 4 year old boy was diagnosed with lead poisoning after he and his mother resided in the defendant's apartment in Middletown, Connecticut for over four years. Suit was instituted against the defendant landlord because the child had sustained various injuries, including elevated blood lead levels from lead poisoning resulting in moderate to severe neuropsychological and neurodevelopmental impairments, according to the plaintiff's expert. The expert also opined that the child has sustained cognitive deficits resulting in loss of IQ points, attention deficit hyperactive disorder, executive function deficits and disruptive behavior. The case settled for the total sum of $775,000.00 following a mediation before a retired Superior Court Judge.

Dog Bite

Dog Bite - $194,890.66 arbitration award for a 31 year old letter carrier who sustained injuries when he was attacked by two dogs while attempting to deliver the mail. As a result of his injuries, the plaintiff had to undergo an ACL reconstruction on his left knee. Thereafter, the plaintiff was caused to undergo physical therapy and ultimately lost his job with the post office. The man has also made a claim for workers' compensation benefits through the U.S. Department of Labor Office of Workers' Compensation Programs, which handles workers' compensation claims for post office employees. Dog Bite - 38 year old woman from Bridgeport was bit in the face by a Pitbull while visiting the house of the dog owner. The woman sustained scarring to her face as a result of being bitten by the dog. The case settled for the sum of $150,000.00 before suit was instituted.

Negligent Security

Negligent Security - In 1994, an eleven year old girl was sexually assaulted by a thirteen year old male at an apartment complex where the family resided in West Haven, Connecticut. As a result of the assault, the girl suffered from several injuries including severe mental trauma, post traumatic stress disorder, flashbacks to the assault, depression and suicidal thoughts. Suit was instituted against the owner and manager of the apartment complex in New Haven Superior Court. Legal Malpractice

Legal Malpractice - In 1987, a fifty-eight year old woman was operating a Connecticut Transit bus when her bus was rear ended by a garbage truck owned by a local town. As a result of the accident, the woman sustained various injuries including two herniated discs in her lumbar spine requiring her to undergo surgery on her back. The woman had retained an attorney who had failed to send written notice to the town within the requisite six months and also failed to file suit against the town and the operator of the garbage truck. Attorney Michael Foley was retained by the woman in the case and instituted suit against the responsible attorney and her law firm for legal malpractice. Bicycle Accidents

Bicycle accident - A 74 year old woman was crossing the linear trail, at its intersection with Higgins Road in Cheshire, Connecticut when she was struck by a vehicle operated by an 82 year old woman, causing her to be thrown from her bicycle, and further causing her to sustain various injuries including tears of both the medial and lateral meniscus of the left knee, among other injuries. As a result of the injuries to her knee, the bicyclist was caused to undergo arthroscopic surgery on her left knee. A claim was brought against the driver's insurance company which settled for the driver's policy limits of $100,000.00. A claim was then brought against the bicyclist's automobile insurance carrier for underinsured motorist benefits. The claim for underinsured motorist benefits was settled with the bicyclist's carrier for the sum of $100,000.00, shortly before the parties proceeded to a binding arbitration, for a total settlement of $200,000.00.

Bicycle Accident - A 22 year old graduate student at Yale University sustained various injuries including facial cuts and abrasions, concussion and post-traumatic headaches after he was struck by a car while riding his bicycle across the street in a crosswalk in New Haven, Connecticut. The impact caused the bicyclist to be thrown onto the pavement where he sustained various injuries. Suit was instituted against the driver of the vehicle. Prior to trial, the case proceeded to a binding arbitration which resulted in a arbitration award of $32,791.00 for the injured bicyclist.

Pedestrian Accidents

Pedestrian Accident - A 31 year old woman was struck by a commercial van while crossing in a crosswalk on West Main Street in Meriden, Connecticut and sustained various injuries including injuries to her neck, back and right wrist. The woman also had to undergo surgery on her wrist, specifically an arthroplasty and excision of a ganglion on the right wrist. The case proceeded to binding arbitration and the arbitrator awarded the woman the sum of $114,790.16.

Pedestrian Accident - A 20 year old student at the University of Connecticut sustained a broken ankle after he was struck by a car as he was crossing in a crosswalk at the UCONN campus in Storrs, Connecticut. The impact caused the pedestrian to be thrown onto the hood of the vehicle where he struck the windshield before landing on the road, causing him to sustain a fracture of the right ankle, among other injuries. Suit was instituted against both the owner and driver of the car, who was a fellow college student. The case settled following a mediation for $120,000.00, prior to trial.
