Legal Malpractice

What is Legal Malpractice?

Legal malpractice is the area of the law that deals with situations when an attorney’s negligent conduct has caused his client to sustain damages. In other words, legal malpractice is the failure to perform something that the attorney was required to perform during the course and scope of his representation of his client that results in damage to the client.

The American Bar Association reports that the most common legal malpractice claims involve an attorney’s failure to know the law or apply it correctly. The second most common claim stems from errors made by the attorney in pursuing the law suit appropriately, such as failing to file the lawsuit within the applicable statute of limitations. These cases can be quite complicated and it important that you contact an attorney as soon as possible to assist you in making these claims.

What is the Law in Connecticut on Legal Malpractice?

Connecticut law provides that an attorney may be held responsible for any damage that his client has sustained as a result of the attorney’s negligence or legal malpractice. Legal malpractice can arise in many different types of situations. Two of the most common types of legal malpractice are when an attorney is retained to represent a client in a personal injury case and he fails to institute suit against the responsible parties within the applicable two year statute of limitations or he fails to pursue the case in a diligent fashion and the case is dismissed by the Court. As a result, the client does not recover any compensation for his injuries despite the fact that the other party was at fault for the accident. In these types of cases you may be able to recover the original amount you would have been entitled to from the attorney who committed malpractice.

What Should I do if I Feel My Attorney May Have Committed Legal Malpractice?

If you feel that you sustained damages as a result of the legal malpractice by your attorney, you should contact an experienced legal malpractice attorney right away in order to discuss your rights. As with all cases, there is a statute of limitations in pursuing legal malpractice claims against attorneys in Connecticut, so you should not delay if you feel you have suffered any damages as a result of legal malpractice by your attorney.

Attorney Foley spent 8 long years as my lawyer, during that time he was my advocate, my friend, and above all an amazing lawyer. I wanted to write this review because in most cases lawyers are concerned with their payday, but not Michael Foley, though he was able to get me an amazing settlement, he became like part of my family, truly advocating for the best medical care during the long process. MIchael is an absolute Bulldog when it comes to protecting his clients, if you need someone in your corner, who won’t ever give up on your case, and actually listens to your needs, then look no further..
